2019 Assault of Dacari Spiers

In October 2019, Stangel and Officer Cuauhtémoc Martínez responded to a domestic violence call, where they encountered Spiers and his girlfriend. Martinez exited the police vehicle and attempted to put Spiers up against a wall. Stangel joined, and struck Spiers several times with his baton, breaking his wrist and leg.[2]

The city released a critical incident video that contained the 911 call, dispatcher recordings, and body-worn camera footage.[3]

Response Timeline

In February 2020, Spiers filed a lawsuit against the city for violating his civil rights.[2]

On December 14, 2020, Stangel was charged with battery with serious bodily injury, assault with a deadly weapon, assault with force likely to cause great bodily injury, and assault under color of authority. He faced up to seven years in prison.[2][4]

On January 28, 2022, an investigator for the District Attorney's office testified that she was ordered to withhold evidence in the case. The investigator had interviewed a witness who claimed that Spiers had been beating a woman before Stangel drew his baton.[5]

On February 8, 2022, the city agreed to pay $700,000 to settle the civil lawsuit.[6]

On March 7, 2022, a jury found Stangel not guilty on the assault and battery charges. The judge declared a mistrial on the charge of assault under color of authority, as the jury was split.[2]
