2022 Sexual Assault

In December 2022, Garcia assaulted an off-duty female subordinate deputy during a party he was hosting.[3][4][5]

According to prosecutors, the victim was unconscious at the time of the assault and Garcia contacted the victim to keep from being implicated.[6]

The police union claims that a Lieutenant, Captain, and Chief were aware of the ongoing assault and did not intervene.[7]

Response Timeline

The day after the assault, a rape kit was processed and confirmed the presence of Garcia's DNA.[5]

In December 2022, Garcia was placed on paid administrative leave.[1]

On January 18, 2023, Garcia was arrested and charged with sexual assault.[3]

On January 31, 2023, Garcia was fired.[6]

On June 15, 2023, The victim filed a claim against Garcia, the city, and other officials. A claim is a precursor to a lawsuit.[5][8]

On July 31, 2023, an internal affairs investigation was opened.[8]

On September 19, 2023, the Pima County Board of Supervisors voted to request the state Attorney General's Office conduct an independent investigation into the handling of the case by the Sheriff.[9]

On August 30, 2024, the Attorney General's Office concluded that there was no criminal wrongdoing in the investigation and noted several possible policy violations.[9]

2023 Hit and Run

In February 2023, witnesses saw Garcia back into another vehicle before driving away.[1]
