Improper Force and Search

Fernandez unlawfully detained a man, used improper force, and performed an unlawful search and seizure. Fernandez handcuffed a man in a civil dispute. When handcuffing the suspect, Fernandez allegedly said, "I can do whatever I want." Fernandez searched the man, which was an illegal search and seizure since the man was not under arrest.[2]

Neighbor's Dogs

While off-duty but in uniform, Fernandez confronted a neighbor about his loose dogs, and threatened to "make sure he got cited". The department said that Fernandez used poor judgment.[2]

Search at Repair Shop

Fernandez responded to a complaint of a noise disturbance at a vehicle repair shop, and searched the vehicles VIN numbers to see if they were stolen without getting consent. Fernandez also entered a trailer without probable cause.[2]

In a separate incident described in the same memo, the department describes an unlawful detention where Fernandez suspected two people of dealing drugs. Fernandez was patronizing, and called for a K-9 officer to sniff the vehicle.[2]

2017 Arrest of Elijah Wesbrock

Response Timeline

On April 3, 2019, Wesbrock filed a lawsuit against Gabriel Vasquez, Fernandez, and Air Force Officers Ledford and Ledesma, citing violations of his First and Fourth Amendment rights, and other allegations.[3]

On June 3, 2020, the United States District Court provided a mixed ruling. Several of the counts in Wesbrock's lawsuit were denied due to a 2-year statute of limitations. Charges of malicious prosecution, supervisor liability, and conspiracy were allowed to continue.[3]

2017 Arrest of Johnny Wheatcroft

Fernandez arrived on the scene during the traffic stop and was responsible for handcuffing and restraining Wheatcroft.[2] Fernandez also applied his taser to Wheatcroft. [4]

Response Timeline

On November 5, 2018, Wheatcroft and Chapman sued the city, Schneider, Lindsey, and Fernandez based on First, Fourth, and Fourteenth Amendment violations.[4]

On September 9, 2021, criminal charges were only brought against Matt Schneider.
