2023 Death of Eddie Irizarry

On August 14, 2023, police saw a car driving erratically. After the driver turned the wrong way on a one-way street and stopped, officers approached the vehicle. Dial ran up to the car, ordered Irizarry to show his hands, and quickly fired. Dial later claimed to see a gun.[1]

Officers put Irizarry in the back of a police vehicle and drove him to the hospital.[4]

Irizarry died.[1]

Police originally reported that Irizarry was shot after exiting the vehicle and lunging at police with a knife. Two days later, the department updated the sequence of events.[1]

The incident was captured on body-worn cameras and surveillance cameras.[1]

Response Timeline

On August 22, 2023, the Citizens Police Oversight Commission recommended that Dial be fired.[5]

Dial was suspended. The department planned to fire him as he refused to cooperate with the investigation.[1]

On September 8, 2023, Dial was charged with murder, voluntary manslaughter, aggravated assault, simple assault, reckless endangering another person, and official oppression.[1]

On September 18, 2023, Dial was fired.[2]

On September 26, 2023, a judge dismissed the charges against Dial, agreeing that Dial believed Irizarry had a gun and feared for his safety.[2]

On September 26, 2023, the city's District Attorney refiled charges of murder, voluntary manslaughter, aggravated assault, simple assault, reckless endangering another person, and official oppression.[6]

On September 27, 2023, Irizarry's family filed a wrongful death lawsuit against Dial and another officer.[7]

On October 25, 2023, a judge reinstated the charges that had been refiled in September.[8]

On August 8, 2024, the District Attorney withdrew the first-degree murder charge against Dial after defense lawyers argued that the prosecutors had not turned over information in the case. Dial will still face a third-degree murder charge.[9]
