Cody Wade (2019)
Overview
On June 28, 2019, Miami Beach Florida Police Department officers Alfredo Garcia and Agustin Rodriguez were asked to escort Wade from a bar. Several minutes later, Wade ran across the street, and the officers tackled and handcuffed him. Garcia struck Wade in the face several times with his elbow, knocking him unconscious. Garcia and Rodriguez dragged Wade to the sidewalk and waited for paramedics to arrive.[1]
The incident was captured on body-worn camera.[1]
Wade was charged with a felony of violently resisting an officer and misdemeanor charges of resisting arrest and trespassing after a warning.[1]
In July 2019, the charge of resisting an officer was dropped.[1]
In October 2019, prosecutors declined to pursue the other charges.[1]
On July 22, 2021, Wade filed a lawsuit against the city, Garcia, and Rodriguez for use of "unreasonable and excessive force".[2][1]
On September 28, 2022, the city approved a settlement of $130,000.[3]
In November 2022, the lawsuit was dropped.[1]
