2008 Official Misconduct
On December 18, 2008, Epperly made a traffic stop. A tractor trailer was seized as part of a drug investigation. Epperly was accused of removing items from the vehicle, including a GPS device that he erased.[5][6]
On December 20, 2008, Epperly was captured on video returning to the stored vehicle to remove additional items.[5]
Evidence custody and vehicle inventory lists filed by Epperly were inconsistent.[5]
Response Timeline
In July 2009, Epperly was charged with felony official misconduct for erasing the GPS device and misdemeanor theft for removing the items from the vehicle.[5]
On January 13, 2010, Epperly was acquitted of the charges after a bench trial as the state had failed to prove the case beyond a reasonable doubt.[5]
On December 1, 2021, Epperly filed to have the arrest expunged from his record.[5]

A judge granted the petition to expunge the false impersonation charges from Epperly's record. Epperly would still be required to disclose the charges if applying for employment in law enforcement or if called as a material witness in court.[1]
On December 30, 2021, the same judge set aside his earlier ruling to also consider the expungement in the 2009 case.[1]
