Overview

Tustin Officer-Involved Shooting Video

Garcia is also referred to as Luis Manuel Garcia-Arias.[1]

On August 9, 2021, Tustin California Police Department officers Estella Silva, Joshua Yuhas, and Hector Frias responded to a call of a man with a knife. Officers encountered Garcia, who was homeless and sleeping in some bushes. Officers ordered Garcia to come out of the bushes. Officer Taylor Babb arrived as the incident was unfolding. Garcia was carrying a bag and a pole, which prompted Yuhas to draw his Taser and Silva to draw her firearm. Yuhas fired the Taser, which was ineffective. Silva fired, striking Garcia.[1][2]

Officers rendered aid until paramedics arrived. Garcia died at the hospital.[1]

The incident was captured on an in-vehicle camera and two officers' body-worn cameras. Silva had left her body-worn camera in her vehicle and Babb did not activate his body-worn camera.[1]

The shooting is being investigated by the Orange County District Attorney's Office and the state Department of Justice, which reviews all officer-involved shootings when the victim was unarmed.[3][4]

On January 20, 2022, Garcia's family filed a lawsuit against the city of Los Angeles and the officers involved, alleging the use of excessive force and delinquency during the arrest.[2]

On March 15, 2024, the state Attorney General released their investigative report, concluding that "criminal prosecution is unsupported by the evidence".[1]
