2018 Arrest of Samuel Scott, Jr.

On June 1, 2018, Scott reported his car stolen, and was arrested after matching the description of the car thief. A Miami Police Department officer named Miguel Hernandez was named in a lawsuit by Scott.[3][4]

2020 Arrest of Julissa Burgos

On November 27, 2020, Hernandez was called to a gas station whose owners wanted to trespass Burgos from the property. A police investigation found that "Ms. Burgos walks past officer Hernandez’s vehicle, appears to turn her cigarette off on his vehicle and continues to walk across the street." Hernandez took offense at this and, with another officer, violently placed the resistant Burgos in handcuffs. Hernandez placed Burgos in the back of his vehicle, where she spat at him. Hernandez grabbed Burgos and threw her onto the ground, knocking her unconscious.[5][2][1]

Burgos was charged with criminal mischief and assault on a police officer. The charges were later dismissed.[1]

The incident was captured on the officers' body worn cameras.[2]

Response Timeline

On April 22, 2021, Hernandez resigned from the department and relinquished his state officer certification.[1]

The State Attorney did not prosecute Hernandez, noting that Burgos "did not want to participate with a prosecution".[1]
