Overview

On April 21, 2021, Creola Alabama Police Department Officer Gary Davis was working as an officer inside the Creola jail where Joshua Brady was incarcerated on drug charges and active warrants.[1][2] Davis was accused of tying a rope around Brady's neck, striking him, and kicking him.[3]

On May 3, 2021, Davis was fired.[2]

On May 7, 2021, a grand jury indicted Davis on two charges of assault, including second-degree assault, which is a Class C felony punishable by one to 10 years in prison, and third-degree assault, which is a misdemeanor punishable by up to a year in jail.[2]

On September 20, 2021, the charges against Davis were upgraded to attempted murder, second-degree assault, and first-degree kidnapping.[1]

On May 25, 2022, Davis pleaded guilty to federal charges deprivation of rights under color of law.[4] Davis faces up to 10 years in prison.[5]

On September 6, 2022, Davis was sentenced to time served for the federal charge.[6]

On September 14, 2023, Davis pleaded guilty to second-degree assault in exchange for prosecutors dropping the attempted murder charge. The kidnapping charge will also be dismissed. Davis must serve 30 days in jail, with the rest of a five-year sentence suspended.[4]
