Incident Reports

La had other policy violations involving Taser use, body-worn camera recording, prisoner restraint, and a civilian complaint. La received punishments including counseling, verbal reprimands, training, and an eight-hour suspension.[1]

On September 21, 2022, police responded to reports of gunfire and found Garcia trying to break into a business. As he fled, Garcia threw two rocks at La, who fired his handgun at Garcia.[2]

Garcia was charged with aggravated assault on a peace officer and possession of burglary tools.[2]

Response Timeline

An internal investigation found that the first shot fired complied with the department's policy as Garcia posed "an immediate threat", and determined that the additional nine shots were not reasonable and violated the department's policy. The investigation found that La's actions led to the use of force by not de-escalating.[1]

An Independent Monitoring Team stated that all the shots violated the department's policy, "considering the threat [Garcia] posed to the officer".[1]

On February 23, 2023, La was fired.[2]

Garcia took a plea deal with prosecutors and was sentenced to one year of probation.

Garcia filed a lawsuit against La and the city.[1]
