Evan Wollert (2023)
Overview
On February 6, 2023, Colorado Springs Colorado Police Department officers responded to a call of a man on his apartment balcony with a "long gun". Responding officers contacted Wollert, but had no suspicion of a crime, so they started to leave. Wollert starting banging on his neighbor's door and threatened the officers. Officers, believing that their presence might escalate Wollert's behavior, left the scene.[1]
Several hours later, police received reports that Wollert was banging on his neighbor's door, claimed to be armed, and claimed that he had killed someone. One caller reported hearing a gunshot. Police responded, and contacted Wollert, who threatened to "kill them and their children". Wollert refused the officers' commands to exit the apartment, eventually coming back on his balcony with a long gun. Wollert approached the officers with the gun raised and pointed at the officers. Sergeant Aaron Lloyd and officers Steven Nelson and Stewart Smyth fired, striking Wollert.[1]
Officers approached with a ballistic shield, reaching Wollert approximately a minute after the shooting.[2] Officers rendered aid until paramedics arrived. Wollert was pronounced dead at the scene.[1]
The incident was captured on officers' body-worn cameras and a witness's cell phone.
State law requires that an investigation be conducted by an independent agency for incidents where a peace officer shoots and injures or kills a person. The El Paso County Colorado Sheriff's Office opened an investigation.[2]
On August 25, 2023, the District Attorney determined that the officers had attempted to deescalate the situation and that the use of force was justified.[3][1]
