Overview

On September 28, 2017, Topeka Kansas Police Department Officers Justin Mackey and Michael Cruse responded to a report of gunfire near a park. The officers encountered White in the area. During a search, Mackey saw that White was armed. As they attempted to disarm him, White resisted the officers and was shot as he ran away with his hand over the pocket that contained the gun.[1][2] White was pronounced dead at a local hospital.[3]

In 2017, the District Attorney ruled the officers were justified in the shooting and they would not face criminal charges in White’s death.[2]

On June 27, 2018, White's family filed a lawsuit against the officers and the city, alleging that officers violated Mr. White's right against unreasonable seizures under the Fourth Amendment and his right to due process under the Fourteenth Amendment.[4][5]

On January 19, 2019, city officials said an internal police investigation found that the officers followed department policies during the confrontation.[6][7]

On September 28, 2020, the U.S. District Court ruled that the officers had not violated White's Fourth Amendments rights and were entitled to qualified immunity. The charges against the city remain undecided.[2][5]

In November 2021, the family withdrew their lawsuit. No reason was given.[8]
